1. ACCEPTANCE OF THESE TERMS

These Terms and Conditions ("Terms") form an agreement between you and Kickff, Inc. ("Kickff", "we", "us", or "our") governing your use of the Kickff mobile application (the "App").

By creating an account, subscribing, or otherwise using the App, you accept these Terms. If you do not accept them, do not use the App.

2. WHAT KICKFF IS — AND WHAT IT IS NOT

Kickff is an information and analytics product. We publish statistics, projections, ratings and opinion-based predictions about sporting events, assembled by our staff from historical and public data.

We are not a bookmaker, sportsbook, betting exchange, casino, or money-transmission service. We do not accept, place, broker, or settle wagers of any kind. We do not operate real-money or simulated gambling, we do not run contests or fantasy competitions, and we hold no customer funds.

We do not promote, endorse, advertise, or receive commission from any sportsbook, bookmaker, betting site, or gambling operator, and the App contains no links or referrals to any of them.

Everything we publish is provided for informational and educational purposes only. It is one input among many that you may choose to consider. It is not betting advice, financial advice, investment advice, or a recommendation to take any action.

3. NO GUARANTEE, AND NO LIABILITY FOR YOUR LOSSES

WE DO NOT GUARANTEE ANY OUTCOME, RESULT, OR WIN.

Sport is inherently uncertain. Our projections are estimates derived from statistics, and statistics describe what has tended to happen — never what will happen. A pick, rating, projection or probability shown in the App may be wrong, and any of them may be wrong repeatedly. Past accuracy is not a promise of future accuracy.

Every decision you make after reading our content is your own decision, made at your own risk and on your own judgement. You are solely responsible for your own conduct and for complying with the laws that apply where you live.

TO THE FULLEST EXTENT PERMITTED BY LAW, WE ACCEPT NO RESPONSIBILITY OR LIABILITY FOR ANY LOSS YOU SUFFER — financial or otherwise — arising out of or connected with your use of the App or reliance on anything we publish. This includes, without limitation, money lost through any activity you undertake after reading our data, lost profits, lost opportunity, or any indirect or consequential loss.

If you choose to use our information in connection with any activity that involves risking money, you do so entirely at your own risk, and you accept that we are not responsible for the result.

4. ELIGIBILITY

You must be at least 18 years old, or the age of majority in your jurisdiction, and legally able to enter into this agreement.

You are responsible for ensuring that your use of the App is lawful where you are. Access is prohibited where it would breach local law.

5. YOUR ACCOUNT

You agree to provide accurate information, to keep your credentials secure, and to be responsible for everything that happens under your account.

One person, one account. You may not share, sell, rent, or transfer your account or your subscription, and you may not use multiple accounts to obtain access you have not paid for.

You may delete your account at any time from Account → Delete account. Deleting your account does not by itself cancel a subscription — see section 7.

6. SUBSCRIPTIONS AND WHAT THEY INCLUDE

Access to picks is sold as an auto-renewing subscription. Plans are priced by how many sports they cover — one sport, two sports, three sports, or all sports — and are billed weekly, monthly, or annually.

Choosing your sports. On a plan that covers a limited number of sports, you select which sports at the time you subscribe. Your selection is attached to that subscription for the life of that subscription. If you move to a plan covering more sports you will be asked to choose the additional sports; if you move to a plan covering fewer, you will be asked which of your existing sports to keep.

Your subscription is tied to the store purchase, not merely to your login. If you sign in with a different Kickff account on a device that already holds an active subscription, that account receives the same access and the same sports; it is not offered a fresh selection. This prevents a single purchase being multiplied across accounts.

7. BILLING, RENEWAL, AND CANCELLATION

Payment is charged to your Apple ID or Google Play account at confirmation of purchase. Apple and Google are the sellers of record; we do not process payments and do not see your payment details.

Your subscription renews automatically at the then-current price for the same period, unless you cancel at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours prior to the end of the period.

You can cancel at any time. On iOS: Settings → your name → Subscriptions. On Android: Play Store → Payments and subscriptions → Subscriptions. Cancelling stops the next renewal; it does not end the period you have already paid for, and your access continues until that period expires.

Uninstalling the App does not cancel a subscription.

8. FREE TRIALS

We may offer a free trial on some plans. Where a trial is offered, the length shown at the point of purchase applies.

If you do not cancel before the trial ends, the subscription converts automatically to a paid subscription and you will be charged. Cancel before the end of the trial to avoid being charged.

Eligibility for a trial is determined by Apple or Google, not by us. Introductory offers are generally limited to one per subscription group per store account, so a trial may be unavailable if you have used one before.

9. PRICE CHANGES

We may change subscription prices. Where a change affects an existing subscription, you will be notified in advance by the relevant store and, where required, asked to consent before the new price takes effect. If you do not accept the new price you may cancel.

10. REFUNDS

Purchases are made through Apple or Google and are subject to their refund policies. Because they are the sellers of record, they alone can issue refunds. See our Refund Policy for how to request one.

12. INTELLECTUAL PROPERTY

The App and all of its content — including our statistics, projections, ratings, written analysis, design, and branding — are owned by Kickff or its licensors and are protected by intellectual property laws.

We grant you a personal, limited, non-exclusive, non-transferable, revocable licence to use the App for your own personal, non-commercial use for as long as these Terms are in force. No other rights are granted.

Team names, league names, and player names are the property of their respective owners and are used for identification only. We are not affiliated with, endorsed by, or sponsored by any league, team, or governing body.

13. CONTENT ACCURACY AND AVAILABILITY

We take care over our data, but we do not warrant that it is accurate, complete, current, or uninterrupted. Fixtures change, sources contain errors, and picks may be corrected, settled, or withdrawn after publication.

We may add, change, suspend, or remove any part of the App, including sports, leagues and features, at any time.

14. DISCLAIMER OF WARRANTIES

THE APP AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT.

15. LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY LAW, KICKFF AND ITS OFFICERS, EMPLOYEES AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OPPORTUNITY, OR MONEY LOST IN ANY ACTIVITY UNDERTAKEN AFTER USING THE APP.

TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE APP WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.

Some jurisdictions do not allow certain limitations of liability, so parts of this section may not apply to you. Nothing in these Terms excludes liability that cannot lawfully be excluded.

16. INDEMNIFICATION

You agree to indemnify and hold harmless Kickff and its officers, employees and agents from any claim, demand, loss, or expense (including reasonable legal fees) arising out of your use of the App, your breach of these Terms, or your violation of any law or third-party right.

17. TERMINATION

We may suspend or terminate your access at any time if you breach these Terms or if we reasonably believe your use harms the App, us, or other users.

You may stop using the App at any time. Sections concerning intellectual property, disclaimers, limitation of liability, indemnification, and governing law survive termination.

18. CHANGES TO THESE TERMS

We may update these Terms. When we do, we will revise the "Last updated" date above and, for material changes, bring them to your attention in the App. Continuing to use the App after a change means you accept the updated Terms.

19. GOVERNING LAW AND DISPUTES

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-law rules. Disputes will be subject to the exclusive jurisdiction of the state and federal courts located in Delaware, except where mandatory local law gives you the right to bring proceedings elsewhere.

Nothing in this section affects consumer rights that cannot be waived under the law of your country of residence.
